Lease Leaseback 

The acquisition of customary land for Lease - Leaseback is to assist or encourage Papua New Guinea (Landowners) to develop & utilize their own land.

Lease leaseback titles are only issued to Landowners over their customary land upon request in the form of formal application. Their application is processed and all completed documentation are documented and referred to the Minister for approval of granting of lease. It is a direct lease from the landowners to the State . the land is used as security for the mortgage upon recognition of the owners title that provides Fee Simply Title when it is vested with the Landowners.

The application forms can be obtained from the Land Management Office or downloaded or printed.

The lease - leaseback program is provided by the state for landowners to utilize their own land collaterally to obtain mortgage for business development purposes for maximum returns. The mortgage contract with the bank or sublease agreement with the third party does not affect the initial lease agreement binding the State and the Landowners.

This program only applies to "Special Agricultural and Business Leases" and the term of the lease is set by the customary landowners. The landowners can lease the land back to the State who provides a suitable Investor to develop the land or Landowners develop it under the sub-lease agreement.

The lease to the State should not be more than 10 to 20 years and automatically reverts back to the landowners upon the expire of the term of lease.
