Complusory Acqusition
A brief process of compulsory acquisition as depicted in Section 12 of the Land Act (1996)
- A Notice of Treat is served on Landowners under Section 13 of the Land Act to deal with the Minister of his interest on behalf of the State .
Allowance made for landowners for objection in a formal written to the minister, stating their objections.
- The notice to treat will apply after the declaration notice expires for the period of two months.
- State acquires the customary land compulsorily when the landowners delay or refuses to discharge their interest
- This process applies to National interest such as roads, bridges or other types of public easements.
- The Compulsory Acquisition Notice is processed and published in the National Gazette declaring the interest of the State.
- Completion of all land acquisition process, then purchase of land and compensation of Landowners.
